State Compliance & Governance: The NC Planned Community Act
As a planned community, Riverbend at Lake Lure is regulated by the State of North Carolina under Chapter 47F of the North Carolina General Statutes, also known as the North Carolina Planned Community Act.
It is the explicit intent and duty of the Riverbend at Lake Lure POA Board of Directors to fully comply with all state laws and regulations in every facet of community governance, finance, and administration.
Chapter 47F provides a comprehensive legal framework that dictates how Homeowners and Property Owners Associations must operate. This includes, but is not limited to:
Association Meetings: Guidelines on how annual and special meetings are called, noticed, and voted upon.
Board Duties & Governance: The legal responsibilities, powers, and limitations of the Board of Directors.
Governing Documents: Frameworks for creating, amending, and enforcing Bylaws and Covenants, Conditions, and Restrictions (CC&Rs).
Financial Management: Regulations regarding the collection of assessments, management of budget surpluses, and publication of financial records.
Rule Enforcement: Fair legal processes for issuing community citations, conducting grievance hearings, and levying fines.
